In this paper the increase in non-standard forms of employment (temporary work, fixed-term employment contracts, part-time work and marginal part-time work) is explained using a new theoretical approach. It is based upon transaction cost theory and takes a closer look at costs (and revenues) of employment relations: On the one hand, atypical forms of employment reduce labor costs and dismissal costs, but on the other, they increase transaction costs and those for training and skills. In comparison with other European countries, temporary agency work is quite wide-spread in the Netherlands. The German parliament has deregulated the legislation on temporary agency work in 2003, taking into account the Dutch experience. The aim of our paper is to investigate the reasons for differences in the use of temporary agency work between the two countries. Thus, we first compare the regulation of temporary agency work in both countries and provide an overview of its structure, development and extent in Germany and the Netherlands. We show that - contrary to the prevailing view - the share of temporary agency workers in the Netherlands has decreased since 2000. This paper approaches post-fordist work regulation and proposes to analyse the regulation of knowledge work from the perspective of contract relations, it discusses the concept and quantitative extent of knowledge work, and regards project-organisation as a characteristic feature of the post-fordist production mode. The article deals with contract relations of knowledge work within and beyond the standard employment conditions. Subsequently, the terms and perspectives of work regulation in the post-fordist era are examined. Finally the paper argues that the post-fordist mode of work regulation requires a strengthening of the rights of individuals and is characterised by metarules.

As a reaction to the deep crisis of German trade unions, observers as well as union leaders have agreed in the 1990s that organizing atypical workers is a matter of outstanding importance for the future of unions. However, what do unions actually do besides paying lip service to organize atypical workers and to improve their work and pay conditions? Which strategies do German unions pursue? The article addresses these questions by analyzing union strategies towards call centre and temporary-employment agency workers. The article shows that in both cases a similar historical pattern can be detected.
