This paper analyses how far the German population accepts the current legal provisions for employment protection and which layoff selection criteria are preferred. The empirical evidence is based on a telephone survey, which was conducted in the summer of 2004 (n[asymptotically =]3000). The majority of the respondents are in favour of maintaining the status quo for employment protection. Union members and unemployed respondents prefer stronger employment protection. Moreover, the evidence indicates that the consideration of employer's interests is widely accepted by the German population. The selection criteria considered most fair by employees are in accordance with their tenure (seniority and equity principle) and their qualifications (efficiency and achievement principle).

The recent successes of professional unions are undeniable. This essay poses the question whether there is a triple phenomenon of "excluded professionalism" within (German) union history, its historiography and corresponding industrial sociology. The article argues there is a need for greater attention to professions and professionalism as principles binding union members to representative organizations, and therefore to learn from the current success of these unions instead of criticizing or even rejecting them. Mini-jobbers in the retail sector are facing highly precarious working conditions and widespread violation of worker rights. This is what was found in an exploratory study based on semi-structured interviews with managers and employees in 22 outlets of 18 different retail companies and two retail head-offices in Saxony (former East Germany). Even though German labour law requires all employees to be treated equally, the unemployment rate of around 15 percent in the region induces many mini-jobbers to accept wages almost half the collective bargaining rate. As a rule they don't get paid holidays and sickness absence, are called in to work and sent home at short notice, receive hardly any training and can be made redundant any time since many do not have a written work contract.
