In dem Wehrbeschwerdeverfahren hat der 1. Wehrdienstsenat des Bundesverwaltungsgerichts durch
den Vorsitzenden Richter am Bundesverwaltungsgericht Dr. Häußler,
den Richter am Bundesverwaltungsgericht Dr. Langer und
die Richterin am Bundesverwaltungsgericht Dr. Eppelt
am 20. September 2023 beschlossen:
Das Ruhen des Verfahrens wird angeordnet.
1 Der Antragsteller (Schreiben vom 31. August 2023) und das Bundesministerium der Verteidigung (Schreiben vom 15. September 2023) haben auf Anregung des Gerichts im Hinblick auf den Gesundheitszustand des Antragstellers übereinstimmend das Ruhen des vorliegenden Verfahrens beantragt. Das Ruhen des Verfahrens ist anzuordnen, weil die Beteiligten dies beantragt haben und anzunehmen ist, dass diese Anordnung zweckmäßig ist (§ 23a Abs. 2 Satz 1 WBO i. V. m. § 173 VwGO und § 251 ZPO).
