Summary: The facts:Investigations against two accused2 for possible fraud started in June 1960. Large quantities of files of hospital reports and accounts in the possession of the accused were seized and carefully checked and an expert opinion was sought. Charges were preferred in March 1965 and the trial opened in December 1965. The court released its judgment in June 1966, which was quashed on appeal by the Federal Supreme Court in January 1967 for the reason that the public had been wrongly excluded from the hearing. In fresh proceedings, the objections of the accused to the expert appointed were upheld and another expert was not appointed until February 1970. After objections to his appointment were rejected in September 1970, the accused applied to the Provincial Court asking for the proceedings to be terminated for violation of the duty to provide a hearing within a reasonable time under Article 6 (1) of the European Convention on Human Rights.
Held:The application was rejected.
(1) The intention of Article 6(1) of the Convention was that a person was entitled to both a hearing and decision within a reasonable time, and this requirement covered the entire proceedings up to their final conclusion (including appeals).
(2) The reasonableness of the length of proceedings was to be judged in relation to the amount of time necessarily required for them, bearing in mind the obligation of the prosecuting authorities and the courts to expedite proceedings.
(3) Factors particular to the accused such as the gravity of the charge, the measure of his guilt, the prospect of a reliable and complete determination of the facts and the impairment of his health, mental state and financial position, were irrelevant.

Defence counsel asks for the proceedings against both accused to be stayed, relying on Article 6 (1) of the European Convention on Human Rights (ECHR), the first sentence of which provides:
Defence counsel points out that the investigations against the two accused were started in June 1960, that the accused knew about the investigations pending against them from November 1960 at the latest and that both have now suffered the pressure of pending proceedings for more than ten years.
