The Facts.—The accused was charged before a United States Military Tribunal with participation in actions involving, inter alia: (1) the deportation to slave labour of large numbers of civilian inhabitants of Austria, Poland, Czechoslovakia, Italy, Hungary and other countries under the belligerent occupation of Germany, during the course of which they were ill-treated, tortured and killed; (2) the use of prisoners of war in war operations and in work having a direct relation to war operations, their ill-treatment and murder; (3) the conducting of medical experiments, without their consent, on prisoners of war and civilian inhabitants of occupied countries; (4) the deportation to slave labour, ill-treatment, killing, and the conducting of medical experiments, without their consent, on German nationals and nationals of other countries.
Between 1939 and 1945 the accused held the positions of Field-Marshal and Inspector-General of the German air force, Secretary of State in the Air Ministry and representative of the armed forces on the Central Planning Board. The latter was established in 1942 with the purpose of procuring and distributing labour and materials necessary for the conduct of the German war economy. The Board consisted of Reich Minister Speer, Under-Secretary Koerner and the accused, each member exercising equal authority. Meetings of the Board were held weekly and the accused presided over or was present at a majority of them. The minutes of the meetings showed the constant concern of the members with the problem of labour. Sauckel, the minister responsible for the procuring of labour for the German war effort, often appeared before the Board in order to report on the situation regarding the supply of foreign labour. It was established by the evidence that the accused knew that civilian inhabitants of occupied territories and prisoners of war had been employed in German armament production and that some twenty thousand Russian prisoners of war had been used to man anti-aircraft guns
protecting various industrial plants; and that he was aware of the inhuman methods used for recruiting foreign labour and of the ill-treatment of civilians and prisoners of war. He pleaded that he had acted in obedience to superior orders and that he was in no way responsible for the death and ill-treatment of the deported civilians and prisoners of warHeld: that the accused was guilty of all the charges with the exception of that relating to the conducting of medical experiments.1 With regard to the latter, the...
