Saar Territory — Status of — German Sovereignty in Saar Territory — Saar Territory as German Territory — Special Nationality for Inhabitants of Saar Territory — Legality of Action of Governing Commission in Assimilating Relations between Saar Territory and German Reich to those Existing between Independent States.

The Facts.—German Penal Law prescribes a heavier penalty for certain offences, e.g. fraud, if the accused can be shown to have been convicted of the same offence on previous occasions within a specified period, provided that the previous conviction had taken place in Germany (Section 264 of the Penal Code).

In the present case the accused was tried for fraud, and the question to be decided was whether he was to be convicted under Section 264. The accused had previously been convicted on a charge of fraud in St. Wendel (Saar Territory) on 17...
